ABOUT THESE TERMS

These Ticket & Event Terms and Conditions ("Terms") apply to tickets purchased for, and attendance at, events organised or operated under The Paranormal Festival brand.

The Paranormal Festival is operated by Gatherstone Ltd.

References to "The Paranormal Festival", "we", "us", "our" or the "Organiser" mean Gatherstone Ltd when operating The Paranormal Festival.

These Terms are intended to apply across The Paranormal Festival as an events brand and are not limited to a particular festival, venue, date or event format.

Events may include festivals, conventions, exhibitions, talks, panels, workshops, screenings, live entertainment, performances, meet-and-greets, paranormal-themed activities, demonstrations, investigation-style experiences, social events, networking events, competitions, online or hybrid events and other related experiences.

Individual events may have additional event-specific conditions which supplement these Terms.

02

YOUR CONTRACT WITH US

When you purchase a ticket for an event organised by us, your contract for attendance is with Gatherstone Ltd, unless we clearly tell you otherwise before purchase.

Your contract may comprise:

  • these Terms;
  • the relevant event description;
  • your ticket type and included benefits;
  • event-specific conditions brought to your attention before purchase;
  • applicable venue rules; and
  • any other terms expressly incorporated into your booking.

By completing a ticket purchase, you confirm that you accept the Terms applicable to that booking.

Where you purchase tickets for other people, you are responsible for making them aware of relevant event conditions. Certain obligations relating to behaviour, safety, security and venue rules also apply directly to every attendee.

Nothing in these Terms excludes, restricts or removes statutory rights which cannot lawfully be excluded or restricted.

03

EVENT-SPECIFIC INFORMATION

Different Paranormal Festival events may have different dates, venues, opening hours, programmes, activities, age restrictions, ticket categories, capacity limits, accessibility arrangements, security requirements and entry conditions.

You should read the relevant event page and information presented during booking alongside these Terms.

Where an event-specific term expressly differs from these general Terms, the event-specific term will apply to that event to the extent of the difference, provided that the term is lawful and was appropriately brought to your attention.

04

TICKET PRICES AND FEES

Ticket prices will be displayed as part of the relevant sale.

Where a price is advertised to consumers, the total price must include mandatory fees, taxes and charges capable of being calculated in advance as required by applicable law.

We will not deliberately advertise an unavoidable headline price and subsequently introduce hidden mandatory charges during checkout.

Genuinely optional products, upgrades or extras may be charged separately where clearly presented as optional.

05

TICKET TYPES

We may offer ticket categories including:

  • Early Bird;
  • General Admission;
  • VIP or enhanced packages;
  • concession tickets;
  • evening-only tickets;
  • session-specific tickets;
  • promotional tickets;
  • complimentary tickets;
  • competition tickets; and
  • other event-specific categories.

The benefits associated with each ticket category will be described when offered.

A ticket does not entitle its holder to benefits or access expressly reserved for another ticket category.

06

EARLY BIRD TICKETS

Early Bird tickets are strictly limited in quantity and are sold on a first-come, first-served basis.

Receiving an Early Bird email, registration confirmation or code does not reserve a ticket or guarantee availability.

A booking is only secured once the required payment has been successfully completed and confirmation issued.

07

BOOKINGS

Starting a checkout process does not reserve or guarantee tickets.

A booking will generally be confirmed when:

  1. the required payment has been successfully processed; and
  2. a booking or ticket confirmation has been issued.

If payment fails, is reversed, charged back or otherwise not successfully completed, we may treat the booking as unpaid or invalid, subject to applicable law.

You are responsible for checking your booking confirmation and notifying us promptly of any apparent error.

08

THIRD-PARTY TICKETING PROVIDERS

We may use third-party ticketing or payment providers.

Those providers may have separate terms governing their own platforms and services.

Where Gatherstone Ltd is identified as the organiser and contracting party for the underlying event, use of a third-party platform does not remove any responsibility which Gatherstone Ltd has under applicable law.

09

NO GENERAL 14-DAY COOLING-OFF PERIOD

Tickets for leisure activities taking place on a specified date or during a specified period will generally fall within the statutory exception to the usual 14-day cancellation period applicable to many online purchases.

You should therefore ensure that you can attend before purchasing.

This does not remove rights arising where, for example, we cancel an event, fail to provide the contracted service, make a material change giving rise to a legal remedy, or applicable law otherwise provides a right to a refund or other remedy.

10

CUSTOMER CANCELLATIONS

Unless expressly stated otherwise when purchasing, tickets are generally non-refundable where you simply change your mind or become unable to attend.

Examples may include:

  • personal scheduling conflicts;
  • illness or changes in personal circumstances;
  • transport disruption not caused by us;
  • accommodation problems not caused by us;
  • failure to arrange appropriate travel;
  • failure to obtain any insurance you consider appropriate; or
  • deciding that you no longer wish to attend.

This provision applies only to the extent permitted by law.

Nothing in these Terms allows us to retain payments where doing so would be unlawful or where you have a statutory right to a refund.

11

TICKET TRANSFERS AND RESALE

Transfer arrangements may depend upon the particular event, ticket type, security requirements and ticketing platform.

Where transfers are permitted, an official transfer process may be required.

Tickets must not be fraudulently duplicated, altered, forged or resold in a manner which breaches applicable law, misrepresents the ticket, falsely implies an association with The Paranormal Festival, circumvents ticket restrictions or creates a legitimate safety or security concern.

We may invalidate tickets where we have reasonable grounds to believe they have been fraudulently obtained, duplicated or unlawfully resold, subject to applicable consumer rights.

Tickets should only be purchased directly through our official website or an official ticketing partner authorised by us. Tickets purchased from unofficial resellers, resale marketplaces or private sellers are bought entirely at the buyer's own risk. Full details are set out in our Ticket Resale & Third-Party Purchase Policy, available via the Policies page on our website.

12

ADMISSION

A valid ticket gives its holder the right to seek admission subject to:

  • these Terms;
  • applicable ticket conditions;
  • reasonable venue rules;
  • applicable age restrictions;
  • capacity restrictions;
  • safety and security requirements; and
  • lawful and reasonable instructions from authorised event, venue or security personnel.

Possession of a ticket does not provide unrestricted access to every area, activity, room or session.

Some activities may require separate booking, operate on a first-come basis, have limited capacity or be restricted to particular ticket categories.

13

CAPACITY, SEATING AND ACCESS TO ACTIVITIES

Individual rooms, talks, demonstrations, workshops and activities may have capacities lower than the overall event capacity.

Unless specifically sold as guaranteed or reserved access, a general admission ticket does not guarantee entry to every individual activity or room.

Access may temporarily be restricted where an area reaches its safe operating capacity.

Unless expressly stated otherwise, seating may be unreserved, limited and available on a first-come basis.

14

AGE GUIDANCE, CHILDREN AND CONTENT WARNINGS

The following event-specific conditions apply to The Paranormal Festival at Chester Town Hall on 23 October 2027.

The Age & Young Person Policy forms part of these Terms. The daytime portion of The Paranormal Festival is open to guests aged 11 and over. Guests under the age of 11 are not permitted to attend and will be refused entry.

All guests aged 11–17 must attend with and remain accompanied and supervised by a responsible adult aged 18 or over, who must remain on the event premises and be reasonably available to supervise them at all times. If a young person is found on their own, staff will stay with them until they are reconnected with their accompanying adult, and both will then be asked to leave the festival for safety reasons; where removal results from a breach of clearly stated event rules, refunds will not normally be provided, subject always to applicable consumer law and statutory rights.

The festival is centred around paranormal, supernatural, spiritual, historical and occult subjects and may include allegedly haunted objects, discussions of death and the afterlife, references to death, violence or tragedy, frightening or potentially graphic imagery, dark environments, loud or sudden sounds, theatrical effects, mediumship-related content, mature subject matter and occasional strong or explicit language. As a live event with independent speakers, exhibitors and attendees, we cannot guarantee that all content will be appropriate for every young person.

The accompanying adult is responsible for deciding whether the festival and its individual activities are appropriate for the young person in their care, and should remove them from any activity or area they consider unsuitable.

General admission does not guarantee access to every activity. Certain talks, exhibits, rooms or experiences may carry their own higher age restriction (such as 14+, 16+ or 18+), which must be respected even where a young person is accompanied by an adult.

The designated late-evening party runs from 8PM until late and is strictly 18+. Under-18s must leave the designated evening-party area before it begins at 8PM, and being accompanied by an adult does not permit entry. An adult who has attended with someone under 18 and wishes to stay for the party must leave with them, unless the young person can leave safely and is collected by another accompanying adult aged 18+. Valid photographic ID may be requested, and anyone unable to provide satisfactory proof of age may be refused access to an age-restricted area.

By purchasing a ticket you accept the Age & Young Person Policy. Anyone purchasing a ticket for, or bringing, a guest aged 11–17, and the accompanying responsible adult, also agree to follow reasonable instructions from event and venue staff relating to age restrictions, supervision, safety and safeguarding.

Age restrictions and content warnings may vary at future events and activities. The event-specific information shown during booking will apply alongside these Terms.

15

ACCESSIBILITY

We aim to make our events welcoming and accessible and will consider reasonable adjustments in accordance with applicable law.

Accessibility arrangements may vary depending upon the venue, event format, building characteristics, activities and safety requirements.

Some events may take place within historic, listed or unusual buildings where structural features can affect accessibility.

Attendees requiring accessibility information or reasonable adjustments are encouraged to contact us sufficiently in advance where possible so appropriate arrangements can be considered.

Nothing in these Terms limits rights under applicable equality legislation.

16

EVENT PROGRAMMES

Published programmes represent our planned programme at the relevant time but live events may require changes.

We may make reasonable alterations to timings, rooms, running orders, speakers, vendors, activities, demonstrations, layouts or supporting entertainment because of circumstances including:

  • illness;
  • travel disruption;
  • technical difficulties;
  • operational requirements;
  • health and safety;
  • safeguarding;
  • venue requirements;
  • legal requirements;
  • security concerns;
  • contractual issues; or
  • circumstances outside our reasonable control.

Minor or reasonable operational changes will not ordinarily constitute cancellation where the overall event remains substantially as contracted.

17

SPEAKERS, PERFORMERS, INVESTIGATORS AND SPECIAL GUESTS

Unless a ticket is expressly sold as admission solely to a particular individual appearance, tickets are purchased for The Paranormal Festival event as a whole rather than solely for the appearance of any particular speaker, investigator, performer, celebrity, medium, creator, exhibitor or guest.

All advertised appearances remain subject to circumstances which may reasonably affect availability.

Where reasonably necessary, we may alter running times, session lengths, rooms or presentation arrangements, or substitute or remove a participant.

The cancellation or substitution of one participant will not automatically constitute cancellation of the entire event.

However, we will consider the significance of any change and any remedies required by applicable consumer law. Nothing in this section gives us an unrestricted right to fundamentally change the contracted event without regard to your legal rights.

18

MATERIAL CHANGES

Where a change materially alters the contracted event, we will consider its nature, significance and effect upon affected ticket holders.

Depending upon the circumstances and applicable law, appropriate options may include:

  • attending the changed event;
  • transfer to another event where appropriate;
  • voluntarily accepting credit; or
  • a monetary refund where legally required or otherwise considered appropriate.

We will not require a consumer to accept credit instead of money where they have a legal right to a monetary refund.

19

CHANGE OF VENUE OR DATE

We may change a venue where reasonably necessary.

A reasonably comparable venue change will not automatically constitute cancellation.

Factors including location, distance, accessibility, facilities, capacity and impact upon attendees will be considered when determining whether a change is material.

If an event is moved to another date, affected ticket holders will be informed as soon as reasonably practicable.

Where a date or venue change is material, appropriate options will be provided having regard to applicable law.

20

POSTPONEMENT OR CANCELLATION

If an event is postponed, tickets may remain valid for the rescheduled event where appropriate.

Affected customers will be informed of the new arrangements and applicable options.

If we cancel an event and do not provide the contracted event or an agreed replacement, ticket holders will receive the remedies required by applicable law.

Where a refund is due, it will ordinarily relate to amounts paid to us for the affected ticket and any additional amounts which applicable law requires us to refund.

21

TRAVEL, ACCOMMODATION AND OTHER THIRD-PARTY COSTS

Travel, accommodation, parking, restaurants, childcare and similar arrangements independently booked by attendees are normally separate contracts between the attendee and the relevant third party.

To the fullest extent permitted by law, we are not responsible for independent third-party expenditure which we did not sell or contract to provide.

Nothing in this section excludes liability for a loss where applicable law makes us responsible for that loss.

Attendees should consider cancellation terms and appropriate insurance when making separate arrangements.

22

CIRCUMSTANCES OUTSIDE OUR REASONABLE CONTROL

Events may be affected by circumstances outside our reasonable control, including:

  • severe weather;
  • flooding;
  • fire;
  • major transport disruption;
  • venue closure;
  • utility or power failure;
  • public-health emergencies;
  • acts or requirements of government or public authorities;
  • terrorism or credible security threats;
  • war;
  • civil disorder;
  • industrial action;
  • serious infrastructure or widespread technical failure;
  • emergency venue restrictions; or
  • similar exceptional circumstances outside our reasonable control.

Where reasonably necessary, we may delay, modify, relocate, reschedule, curtail or cancel an event in response.

We will take reasonable steps to manage the situation and communicate material changes where practicable.

Nothing in this section removes statutory rights or remedies.

23

EMERGENCIES AND EVENT CURTAILMENT

For safety, security, legal or emergency reasons, it may become necessary to temporarily suspend an activity, evacuate an area, alter the programme, restrict access, delay proceedings or bring part or all of an event to an early conclusion.

Attendees must follow instructions issued by event staff, venue staff, security personnel and emergency services.

Where an event is materially curtailed, any entitlement to a remedy will depend upon the circumstances, the proportion of the contracted service already provided and applicable law.

24

VENUE RULES

Attendees must comply with reasonable venue rules.

These may relate to fire safety, security, smoking, vaping, alcohol, food and drink, bags, restricted areas, emergency procedures, prohibited items, photography, capacity and accessibility.

Where an unusual or important restriction is known in advance and materially affects attendance, we will seek to communicate it appropriately.

25

SECURITY AND SEARCHES

Reasonable security measures may operate at events, including:

  • ticket checks;
  • bag checks;
  • age verification;
  • wristbands;
  • security screening;
  • CCTV where operated lawfully; and
  • inspection for prohibited items.

Searches will be conducted in accordance with applicable law and venue procedures.

Refusal to comply with a reasonable and lawful condition of entry required for safety or security may result in refusal of admission.

26

PROHIBITED ITEMS

Depending upon the event and venue, prohibited items may include:

  • illegal drugs;
  • unlawful weapons;
  • items reasonably considered dangerous;
  • explosives;
  • fireworks or pyrotechnics;
  • hazardous substances;
  • unauthorised alcohol;
  • naked flames, candles or incense where prohibited;
  • items capable of causing injury;
  • items prohibited by the venue; and
  • other items reasonably restricted for legitimate safety or security purposes.

Event-specific restrictions may also apply.

27

ALCOHOL, DRUGS, SMOKING AND VAPING

Where alcohol is available, applicable licensing laws and venue rules apply.

We, the venue or relevant licensed operator may request identification, refuse alcohol service or take reasonable action where an attendee appears seriously intoxicated or behaves dangerously.

Illegal drugs are prohibited.

Smoking and vaping are permitted only where allowed by the venue and applicable law.

28

ATTENDEE CONDUCT

The Paranormal Festival is intended to provide a safe and welcoming environment.

Attendees must not engage in conduct including:

  • violence or threats;
  • harassment or intimidation;
  • discriminatory abuse;
  • serious antisocial behaviour;
  • deliberate or persistent disruption;
  • dangerous behaviour;
  • unlawful conduct;
  • deliberate or reckless damage;
  • unauthorised access to restricted areas;
  • aggressive behaviour towards staff, volunteers, speakers, exhibitors or attendees;
  • conduct creating a significant safety risk; or
  • serious refusal to follow reasonable safety, security or venue instructions.
29

REFUSAL OF ADMISSION AND REMOVAL

We may refuse admission or require a person to leave where there is a reasonable and proportionate basis for doing so.

Reasons may include:

  • invalid or fraudulent tickets;
  • failure to satisfy an applicable age requirement;
  • serious breach of these Terms;
  • violence or threats;
  • harassment;
  • serious intoxication;
  • possession of prohibited items;
  • dangerous conduct;
  • attempted unauthorised access;
  • significant disruption;
  • damage to property; or
  • refusal to comply with reasonable safety or security instructions.

Where an attendee is legitimately refused admission or removed because of their own serious misconduct or material breach of these Terms, a refund will not ordinarily be provided.

Nothing in this section permits discriminatory, arbitrary or otherwise unlawful refusal or removal.

30

DAMAGE TO PROPERTY

Attendees must take reasonable care of the venue, event equipment and the property of others.

A person who deliberately or negligently damages venue property, equipment, fixtures, stock or other property may be responsible for the reasonable loss or repair costs resulting from that damage to the extent permitted by law.

Serious or deliberate damage may also result in removal and, where appropriate, referral to venue security or the police.

31

RESTRICTED AREAS

A ticket permits access only to areas made available to the relevant ticket category.

Attendees must not enter backstage areas, staff-only areas, closed rooms, plant rooms, rooftops, cellars, tunnels, basements, unsafe areas, private venue areas or other restricted areas unless expressly authorised.

The historical, architectural or paranormal interest of a particular area does not grant attendees permission to access it.

32

PARANORMAL ACTIVITIES

Events may include investigation-style experiences, equipment demonstrations, storytelling, spiritual or psychic-themed content, historical paranormal material, audience participation and other interactive experiences.

Participation in optional activities is voluntary unless an activity forms an unavoidable and clearly described part of the event.

Attendees participating in activities must follow reasonable instructions provided by event staff, venue personnel and activity providers.

33

NO GUARANTEE OF PARANORMAL ACTIVITY

We do not guarantee that attendees will:

  • witness paranormal activity;
  • experience unexplained phenomena;
  • capture evidence;
  • receive spirit communication;
  • receive a particular reading or message;
  • obtain investigative results; or
  • experience a particular outcome from equipment, demonstrations or activities.

The Paranormal Festival brings together entertainment, experiences, investigations, discussions, beliefs and perspectives concerning paranormal and unexplained subjects.

The inclusion of a speaker, claim, demonstration, vendor, investigator or activity does not mean Gatherstone Ltd represents that any underlying paranormal claim has been scientifically established or objectively verified.

34

PSYCHIC, SPIRITUAL AND SIMILAR CONTENT

Psychic, spiritual, mediumship or similar content may be present at some events.

Unless expressly stated otherwise, such content should be understood within the entertainment, cultural, spiritual or personal-belief context in which it is presented.

It must not be treated as a substitute for professional medical, mental-health, legal, financial or emergency advice.

Individual practitioners remain responsible for representations and services they independently provide, subject to any responsibility Gatherstone Ltd cannot lawfully exclude.

35

PARTICIPATION AND PERSONAL RESPONSIBILITY

Some activities may involve dark environments, historic spaces, unusual surroundings, specialist equipment or audience participation.

Participation in optional activities is at the attendee's discretion.

Attendees must:

  • follow reasonable safety instructions;
  • use equipment as instructed;
  • remain within authorised areas;
  • inform the activity provider if an instruction is unclear; and
  • refrain from conduct likely to endanger themselves or others.

Nothing in these Terms requires an attendee to waive legal rights relating to injury or loss caused by negligence or another liability which cannot lawfully be excluded.

36

HISTORIC AND UNUSUAL VENUES

Events may take place within historic, listed, heritage or otherwise unusual venues.

Such venues may contain stairs, uneven floors, low ceilings, reduced lighting, historic surfaces or other inherent architectural characteristics.

Attendees should exercise reasonable care and follow venue instructions.

We will work with venues to manage safety and accessibility requirements as appropriate.

Nothing in this provision excludes or limits a duty which cannot lawfully be excluded.

37

MEDICAL EMERGENCIES

Where an attendee appears to require urgent medical assistance, we or the venue may contact first aid personnel or emergency services as reasonably appropriate.

Attendees remain responsible for carrying medication or medical equipment they normally require.

Where appropriate and reasonably practicable, attendees are encouraged to inform us in advance of accessibility requirements relevant to their safe participation.

Nothing in this provision makes us responsible for medical treatment beyond duties imposed by law.

38

PHOTOGRAPHY, FILMING AND RECORDING BY US

Photography, video and audio recording may take place throughout our events.

Material may be used for:

  • documenting the event;
  • The Paranormal Festival website;
  • social media;
  • advertising;
  • future event promotion;
  • press and publicity;
  • editorial content; and
  • promotional films and materials.

Appropriate notices may be displayed informing attendees that recording is taking place.

Attendees may appear incidentally in crowd or event footage.

Personal information associated with identifiable imagery will be processed in accordance with our Privacy Policy and applicable data-protection law.

Where you have a particular concern regarding photography or filming, please contact or speak with the event team where reasonably practicable.

39

ATTENDEE RECORDING

Personal photography or recording may be permitted subject to venue and event rules.

Attendees must respect:

  • other people's privacy;
  • performers' and speakers' rights;
  • intellectual property rights;
  • restricted areas;
  • commercially sensitive material; and
  • any applicable no-recording instruction.

We may prohibit or restrict professional, commercial, intrusive or disruptive filming, photography, livestreaming or recording without prior written approval.

40

INTELLECTUAL PROPERTY

The Paranormal Festival name, logos, branding, original graphics, promotional materials, programmes, event-produced photographs, video, written materials and other original content belonging to Gatherstone Ltd remain its intellectual property or that of the applicable rights holder.

Attendance at an event does not grant permission to reproduce, distribute, broadcast, commercially exploit or falsely represent an association with protected event material.

Nothing in this section claims ownership of intellectual property belonging to speakers, exhibitors, attendees, photographers or other third parties.

41

MEDIA AND COMMERCIAL RECORDING

Professional photography, broadcasting, livestreaming, journalism, commercial filming or other professional recording may require prior written accreditation or approval.

Accreditation does not automatically grant access to backstage areas, staff areas, private rooms, restricted sessions or private conversations.

Separate media conditions may apply.

42

PERSONAL BELONGINGS

Attendees remain responsible for personal belongings unless an item has been formally accepted into our custody.

To the extent permitted by law, we are not responsible for loss, theft or damage where the loss was not caused by a breach of duty for which Gatherstone Ltd is legally responsible.

Nothing in this provision excludes liability which cannot lawfully be excluded.

43

INDEPENDENT VENDORS AND EXHIBITORS

Events may include independent vendors, exhibitors, investigators, practitioners, creators and other businesses.

Unless expressly stated otherwise, purchases and services obtained directly from an independent trader are contracts between the attendee and that trader.

Independent traders remain responsible for their own products, services, pricing, descriptions, representations, legal obligations and applicable consumer rights.

Acceptance of a trader at an event does not constitute a guarantee or endorsement by Gatherstone Ltd of every product, service, statement, opinion or claim made by that trader.

Nothing in this provision removes responsibility which applicable law places upon Gatherstone Ltd.

44

SPEAKERS, EXHIBITORS, CONTRACTORS AND OTHER COMMERCIAL PARTICIPANTS

Speakers, exhibitors, contractors, performers and other commercial participants may be subject to separate written agreements or participation terms.

Those agreements may contain additional provisions concerning:

  • payment;
  • cancellation;
  • insurance;
  • health and safety;
  • electrical equipment;
  • merchandise;
  • intellectual property;
  • recording;
  • publicity;
  • conduct;
  • damage;
  • technical requirements;
  • travel or accommodation;
  • indemnities where legally appropriate; and
  • withdrawal or termination.

Where a separate written commercial agreement applies, that agreement will govern the commercial relationship to the extent expressly stated.

Nothing in these consumer Ticket & Event Terms should be interpreted as replacing an individual commercial agreement.

45

FOOD, DRINK AND ALLERGENS

Food and drink may be provided by the venue, Gatherstone Ltd or independent traders.

Attendees with allergies or dietary requirements should confirm relevant information with the provider responsible for the product before consumption.

We will not describe food as allergen-free unless that can properly be confirmed.

Independent food traders remain responsible for their own legal obligations.

46

PERSONAL DATA

Personal information associated with ticket purchases and attendance will be processed in accordance with The Paranormal Festival Privacy Policy and applicable data-protection law.

Information may be processed where appropriate for purposes including:

  • booking administration;
  • event communications;
  • accessibility arrangements;
  • security;
  • fraud prevention;
  • customer support;
  • legal compliance; and
  • event safety.

Marketing preferences are handled separately.

Purchasing a ticket does not automatically constitute consent to unrelated optional marketing.

47

EVENT COMMUNICATIONS

We may contact the ticket purchaser with information reasonably necessary to administer the booking or event.

This may include:

  • booking confirmations;
  • tickets;
  • entry instructions;
  • venue information;
  • programme information;
  • significant changes;
  • postponement or cancellation information; and
  • safety or security information.

These communications are operational and separate from optional marketing communications.

Ticket purchasers are responsible for providing accurate contact information and should reasonably check communications associated with their booking.

48

LIABILITY

Nothing in these Terms excludes or restricts liability where doing so would be unlawful.

In particular, nothing excludes or restricts liability for:

  • death or personal injury caused by negligence where liability cannot lawfully be excluded;
  • fraud or fraudulent misrepresentation;
  • statutory consumer rights which cannot lawfully be excluded; or
  • any other liability which applicable law prevents us from excluding or restricting.

Subject to those protections, Gatherstone Ltd is not responsible for loss caused solely by matters for which it has no legal responsibility.

This may include loss arising solely from:

  • another attendee's independent actions;
  • an independent vendor's products or services;
  • independent travel or accommodation providers;
  • an attendee's own failure to follow reasonable safety instructions; or
  • circumstances outside our reasonable control,

except to the extent that an act, omission, negligence or other legal responsibility of Gatherstone Ltd caused or contributed to that loss.

49

CONSUMER RIGHTS

If you purchase a ticket wholly or mainly outside your trade, business, craft or profession, you are a consumer.

Nothing in these Terms affects your statutory consumer rights.

Services supplied to consumers remain subject to applicable legal requirements, including requirements relating to reasonable care and skill.

Where these Terms conflict with a mandatory statutory right, the statutory right prevails.

50

FRAUD AND CHARGEBACKS

If you believe a payment or transaction is incorrect, please contact us or the relevant payment/ticketing provider so the issue can be investigated.

Where a payment dispute or chargeback is raised, we may lawfully provide relevant evidence to the applicable bank, card issuer, payment processor or ticketing provider.

This may include booking records, acceptance of applicable Terms, transaction information, correspondence, ticket information and evidence of attendance where relevant.

We reserve the right to challenge fraudulent, abusive or knowingly false disputes.

Nothing in this section restricts a customer's legitimate right to dispute an unauthorised or otherwise legally disputable transaction.

51

COMPLAINTS

Concerns should be raised with event staff as soon as reasonably practicable where an issue can potentially be resolved during the event.

After an event, complaints may be submitted in writing to us.

Please provide sufficient information to allow us to investigate, such as:

  • your name;
  • booking reference;
  • relevant event;
  • details of the issue; and
  • relevant supporting information.

We will review complaints reasonably and fairly.

Submitting a complaint does not automatically create an entitlement to compensation or refund.

Nothing in this complaints procedure prevents the exercise of legal rights.

52

REFUNDS

Where a refund is due, we will normally attempt to return it using the original payment method or relevant ticketing platform.

The amount refunded will be determined according to applicable law and the circumstances of the transaction.

A mandatory fee will not be treated as automatically non-refundable where applicable law requires it to be returned.

Processing times may depend upon banks, payment processors or ticketing providers outside our direct control.

53

ADDITIONAL EVENT-SPECIFIC TERMS

We may issue additional terms for individual events where reasonably necessary.

These may relate to:

  • specialist activities;
  • investigation experiences;
  • venue restrictions;
  • accessibility;
  • age limits;
  • equipment;
  • filming;
  • security;
  • licensing;
  • overnight activities;
  • outdoor activities; or
  • other event-specific requirements.

Additional terms will not retrospectively remove statutory rights already acquired by a consumer.

54

CHANGES TO THESE GENERAL TERMS

We may update these general Terms for future bookings as The Paranormal Festival develops, our operations change or legal requirements are updated.

The version ordinarily applicable to a booking is the version incorporated into the contract when the booking is made, together with any lawful event-specific conditions.

Publishing a new version on our website does not, by itself, retrospectively rewrite an existing consumer contract.

55

SEVERABILITY

If a court or other competent authority finds a provision of these Terms unlawful, invalid or unenforceable, that provision will apply only to the extent that it may lawfully do so.

The remaining provisions will continue to apply where legally possible.

56

NO WAIVER

If we do not immediately exercise or enforce a right under these Terms, this does not automatically mean that the right has been waived.

A waiver will apply only to the particular circumstances in which it is given unless expressly stated otherwise.

57

ENTIRE AGREEMENT

For the relevant ticket booking, these Terms should be read together with the booking confirmation, ticket description, applicable event-specific terms and any other conditions expressly incorporated into the booking.

Nothing in this section excludes liability for fraudulent misrepresentation or affects rights which cannot lawfully be excluded.

Separate written agreements may apply to speakers, exhibitors, sponsors, contractors or other commercial participants.

58

THIRD-PARTY RIGHTS

Unless expressly stated otherwise, these Terms are between the relevant purchaser or attendee and Gatherstone Ltd.

A person who is not a party to the applicable contract does not have a right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999, except where applicable law provides otherwise.

59

GOVERNING LAW

These Terms and contracts for our events are governed by the laws of England and Wales, subject to any mandatory consumer protections which apply where a consumer lives.

Nothing in these Terms deprives a consumer of mandatory legal protections applicable to them.

60

DISPUTES

If a dispute arises, we encourage you to contact us first so that we have an opportunity to investigate and seek an appropriate resolution.

Nothing in these Terms prevents a consumer from bringing proceedings before a court available to them under applicable law.

Any alternative dispute-resolution procedure will only be described or used in accordance with applicable legal requirements.
